TROVAREL TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of Trovarel, including the Trovarel website, marketplace, booking functionality, and related services (collectively, the “Services”).

Trovarel is an online marketplace that allows independent third-party hosts (“Hosts”) to list and offer experiences and services to users (“Guests”). Trovarel provides the technology and marketplace through which Hosts and Guests may connect and arrange bookings.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICES. By creating an account, listing an experience or service, making a booking, or otherwise accessing or using the Services, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree to these Terms, you must not use the Services.

Nothing in these Terms excludes or limits any rights or protections that cannot legally be excluded or limited under applicable law.


1. About Trovarel and Its Role

Trovarel operates an online marketplace designed to connect Guests with independent third-party Hosts offering experiences and services.

Trovarel does not own, operate, control, manage, supervise, or provide the experiences or services listed by Hosts.

Hosts are independent third parties and are not employees, agents, representatives, partners, joint venturers, or contractors of Trovarel solely by virtue of using the Services.

Except where expressly stated otherwise, Trovarel’s role is limited to providing and maintaining the online marketplace, facilitating communications and bookings, processing or facilitating payments where applicable, and monitoring the marketplace for compliance with these Terms and applicable platform standards.

Trovarel is not a travel agency, tour operator, experience provider, insurer, employer, licensing authority, safety certification authority, or professional regulatory body.

A Host’s use of the Trovarel platform does not create an employment, agency, partnership, franchise, or other representative relationship between the Host and Trovarel.


2. Definitions

For purposes of these Terms:

“Trovarel,” “we,” “us,” or “our” means Trovarel and the entity operating the Trovarel marketplace.

“Host” means any individual or business that creates, publishes, advertises, or provides an experience or service through Trovarel.

“Guest,” “you,” or “your” means a person accessing the Services, including a person making or participating in a booking.

“Experience” means any experience, activity, service, event, excursion, transportation-related service, or other offering made available through Trovarel.

“Listing” means the information, description, images, pricing, availability, requirements, and other content submitted by a Host relating to an Experience.


3. Eligibility

You must be at least 18 years old to create an account, become a Host, or make a booking through Trovarel, unless applicable law permits otherwise and Trovarel expressly allows such use.

Hosts must have the legal capacity and authority to enter into agreements and provide the Experiences they list.

Guests are responsible for ensuring that they meet any age, health, experience, qualification, identification, or other requirements applicable to an Experience.

Minors may participate in an Experience only where permitted by applicable law and the relevant Host’s requirements and must be accompanied or supervised as required.


4. Accounts and Accurate Information

Users must provide accurate, complete, and current information when creating an account or using the Services.

You must not:

  • provide false or misleading information;
  • impersonate another person or business;
  • create an account using another person’s identity;
  • misrepresent your qualifications or authority;
  • use the Services for unlawful purposes;
  • attempt to circumvent Trovarel’s security or payment systems; or
  • allow another person to use your account where such use is prohibited.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Trovarel may request additional information or documentation where reasonably necessary to verify identity, eligibility, legal compliance, safety, or marketplace requirements.


5. Trovarel Is a Marketplace

Trovarel facilitates connections between Hosts and Guests.

When a Guest books an Experience, the contractual relationship concerning the actual provision of that Experience is primarily between the Host and Guest, subject to any rights or obligations that may apply to Trovarel under mandatory applicable law.

The Host, not Trovarel, is responsible for providing the Experience.

Trovarel does not guarantee that any Host will perform an Experience, or that an Experience will be available, suitable, safe, lawful, accurately described, or appropriate for a particular Guest.

However, nothing in these Terms limits any legal responsibility Trovarel may have under mandatory applicable law.


6. Host Eligibility and Legal Responsibility

Hosts are solely responsible for determining and ensuring that they are legally permitted to offer and provide each Experience listed on Trovarel.

Before listing or providing an Experience, every Host represents and warrants that:

  1. they are legally entitled to provide the Experience in the location where it is offered;
  2. they possess all licenses, permits, registrations, qualifications, certifications, approvals, and authorizations required by applicable law;
  3. they have all insurance coverage legally required for their activities;
  4. they have any required right to work, residence authorization, visa, professional authorization, or other immigration status necessary to lawfully conduct their activities;
  5. they comply with all applicable tax, social security, employment, business registration, consumer protection, health and safety, environmental, transportation, professional, and regulatory requirements;
  6. they are legally permitted to use any property, equipment, vehicle, vessel, facility, or other item used in connection with the Experience;
  7. all information supplied to Trovarel and Guests is truthful, accurate, current, and not misleading; and
  8. the Experience can legally be provided as advertised.

These obligations apply regardless of whether Trovarel requests documentation demonstrating compliance.


7. Licenses, Permits, Qualifications, Insurance and Right to Work

Hosts are solely responsible for obtaining and maintaining all licenses, permits, registrations, certifications, qualifications, insurance policies, and other legal requirements applicable to their Experiences.

This includes, where applicable:

  • professional licenses;
  • business registrations;
  • tourism or activity licenses;
  • transportation permits;
  • boating or maritime licenses;
  • vessel registration and safety requirements;
  • driving licenses;
  • food safety certifications;
  • health or wellness qualifications;
  • professional qualifications;
  • premises or venue permits;
  • event permits;
  • alcohol-related permissions;
  • insurance;
  • tax registrations;
  • work authorization;
  • residence or immigration permissions; and
  • any other authorization required by the relevant jurisdiction.

For example, if a Host offers a boat Experience, the Host is solely responsible for ensuring that the Host, vessel, crew, and Experience satisfy all applicable licensing, registration, safety, insurance, and regulatory requirements.

A Host must not list or provide an Experience if the Host lacks any authorization required to lawfully provide it.

Trovarel does not provide insurance to Hosts or Guests and does not guarantee that a Host maintains legally required insurance.

Unless expressly stated otherwise on a particular Listing, Trovarel does not independently verify every license, qualification, permit, insurance policy, or other credential of every Host.

Where Trovarel requests evidence of licensing, insurance, qualifications, identity, or legal authorization, the Host must provide the requested documentation within the timeframe specified by Trovarel.

Failure to provide satisfactory documentation may result in suspension or removal of the Listing or Host account.


8. Host Taxes and Financial Obligations

Hosts are independent providers and are solely responsible for determining, reporting, and paying all taxes, duties, social security contributions, business expenses, and other financial obligations arising from their activities.

This may include, depending on the Host and applicable jurisdiction:

  • income tax;
  • corporate tax;
  • VAT or other sales taxes;
  • local taxes;
  • tourism taxes;
  • social security contributions;
  • employment-related taxes;
  • withholding obligations; and
  • any other applicable governmental charges.

Trovarel does not provide tax advice and does not determine a Host’s tax obligations.

Hosts are responsible for obtaining independent professional advice regarding their tax and business obligations.

Trovarel’s collection of commissions or other fees does not constitute confirmation that a Host has complied with any tax, business, employment, immigration, or regulatory requirement.


9. Host Insurance

Trovarel does not provide insurance coverage for Hosts, Guests, Experiences, property, vehicles, vessels, equipment, or activities.

Hosts are solely responsible for determining what insurance is legally required or reasonably appropriate for their activities and for obtaining and maintaining such insurance.

Where insurance is required by law, contract, professional regulation, or the nature of an Experience, the Host must maintain the required coverage for the entire period during which the Experience is offered and provided.

Trovarel may request evidence of insurance and may suspend or remove a Host or Listing if satisfactory evidence is not provided.


10. Host Listings

Hosts are solely responsible for the accuracy and completeness of their Listings.

Hosts must provide:

  • accurate descriptions;
  • accurate pricing;
  • accurate availability;
  • accurate locations;
  • accurate photographs and other media;
  • accurate information about what is included and excluded;
  • accurate participant requirements;
  • accurate age restrictions;
  • accurate qualification requirements;
  • accurate cancellation information;
  • accurate safety information;
  • accurate risk disclosures; and
  • any other information required for Guests to make an informed booking decision.

Hosts must not omit material information that a reasonable Guest would need in order to decide whether to book an Experience.

Listings must not contain false, misleading, deceptive, fraudulent, or materially incomplete information.

Hosts must immediately update or remove information that becomes inaccurate.


11. Safety and Risk Disclosure

Hosts are responsible for identifying and appropriately communicating material risks associated with their Experiences.

Hosts must provide Guests with any safety instructions, warnings, restrictions, equipment requirements, qualification requirements, health requirements, or other information reasonably necessary for safe participation.

Hosts must not knowingly offer Experiences that are unlawful or that cannot be safely conducted in compliance with applicable law.

Where an Experience involves elevated or specialized risks, including but not limited to boating, water activities, transportation, adventure activities, physical activities, food preparation, animals, equipment, or professional services, the Host is responsible for complying with all additional legal and safety requirements applicable to that activity.


12. Guest Responsibilities

Guests are responsible for carefully reviewing a Listing before booking.

Guests must:

  • provide accurate booking information;
  • disclose information reasonably required by the Host for participation;
  • comply with applicable age and eligibility requirements;
  • follow reasonable safety instructions;
  • comply with applicable laws;
  • arrive at the required location and time;
  • use equipment responsibly;
  • respect Hosts and other participants; and
  • determine whether an Experience is appropriate for themselves and any other participant they book for.

Guests are responsible for determining whether they are physically, medically, or otherwise able to participate in an Experience, subject to any legal rights that may apply.

A Guest should not participate in an Experience if doing so would violate applicable law, a medical restriction known to the Guest, or a stated Host requirement.


13. Bookings and Agreements Between Hosts and Guests

A booking request or reservation is subject to the availability and booking terms displayed on the relevant Listing.

Once a booking is confirmed, the Host and Guest enter into an arrangement concerning the provision of the Experience.

The Host is responsible for fulfilling the Experience as described in the Listing.

Trovarel is not responsible for the Host’s performance of the Experience except to the extent required by applicable law or where Trovarel has expressly assumed a particular responsibility.

Hosts and Guests must communicate honestly and in good faith regarding bookings.


14. Payments, Fees and Commission

Trovarel operates on a commission-based marketplace model.

Hosts may create Listings without an upfront listing fee unless otherwise stated.

Trovarel currently charges a 15% commission on completed bookings.

The applicable commission may be deducted from amounts otherwise payable to the Host or collected through the payment process used by Trovarel.

Trovarel reserves the right to modify its commission structure or introduce additional platform fees. Changes will apply to future bookings and will be communicated where required by applicable law.

Any applicable taxes, payment processing charges, or other charges will be disclosed where required.

Trovarel does not guarantee that a Host will receive payment where a payment is reversed, refunded, disputed, cancelled, withheld by a payment provider, or otherwise affected by circumstances outside Trovarel’s reasonable control.


15. Cancellations, Refunds and Changes

Bookings are subject to the cancellation and refund terms displayed for the relevant Experience and any applicable Trovarel cancellation policy.

Hosts must honor the cancellation policy applicable to their Listings.

Hosts may not impose cancellation conditions that contradict the terms displayed to Guests at the time of booking.

Where applicable law provides Guests with mandatory cancellation, withdrawal, refund, or other consumer rights, those rights apply regardless of anything stated in these Terms or a Listing.

Certain services and Experiences may be subject to statutory exceptions to cancellation or withdrawal rights, including services provided on a specific date or during a specific period. The applicable rights depend on the nature of the Experience and the law applicable to the transaction.


16. Trovarel’s Monitoring and Platform Enforcement

Trovarel may monitor Listings, accounts, communications, reviews, and other activity on the Services to maintain marketplace quality, comply with applicable law, address safety concerns, and enforce these Terms.

Trovarel may, where permitted by law:

  • request additional information or documentation;
  • investigate suspected violations;
  • restrict visibility of Listings;
  • edit or require correction of Listings;
  • remove Listings;
  • suspend bookings;
  • suspend or restrict accounts;
  • terminate accounts;
  • withhold or delay payments where permitted;
  • cooperate with competent authorities; and
  • take other reasonable measures necessary to protect the marketplace and its users.

Trovarel’s publication of a Listing does not constitute an endorsement, certification, guarantee, inspection, or verification of the Host or Experience.

Trovarel may remove or suspend a Listing even where the Host disputes the basis for the action.


17. Illegal, Misleading or Unsafe Listings

Hosts must not list Experiences that:

  • violate applicable law;
  • require a license or permit that the Host does not possess;
  • require qualifications the Host does not possess;
  • are falsely represented;
  • are materially misleading;
  • involve fraudulent conduct;
  • create an unacceptable safety risk;
  • involve prohibited goods or services;
  • infringe another person’s rights;
  • involve unauthorized use of property;
  • involve unlawful employment or immigration activity; or
  • otherwise violate these Terms or Trovarel’s policies.

If Trovarel becomes aware of information reasonably indicating that an Experience may be illegal, unsafe, fraudulent, or materially misleading, Trovarel may suspend or remove the Listing and may take any other action required or permitted by applicable law.


18. Host Representations and Indemnification

Each Host represents and warrants that:

  1. the Host is legally entitled to provide every Experience listed;
  2. the Host possesses all required licenses, permits, qualifications, insurance, registrations, and authorizations;
  3. the Host has the necessary right to work or conduct business in the relevant jurisdiction;
  4. the Host complies with all applicable tax and regulatory requirements;
  5. the Experience is accurately described;
  6. the Experience will be provided in accordance with applicable law;
  7. the Host will comply with all applicable safety requirements;
  8. the Host will not knowingly expose Guests to unlawful or undisclosed risks; and
  9. all information supplied to Trovarel is accurate and complete.

To the maximum extent permitted by applicable law, Hosts agree to indemnify and hold harmless Trovarel and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, penalties, costs, and reasonable legal expenses arising from or relating to:

  • the Host’s Experience;
  • the Host’s acts or omissions;
  • injury, illness, death, or property damage arising from the Host’s Experience;
  • the Host’s negligence or misconduct;
  • inaccurate or misleading Listing information;
  • failure to obtain or maintain required licenses, permits, qualifications, registrations, or insurance;
  • failure to maintain lawful work or immigration status;
  • tax obligations or disputes;
  • employment-related obligations;
  • violation of applicable laws or regulations;
  • infringement of third-party rights; or
  • breach of these Terms.

This indemnification obligation does not apply to the extent that a claim results from Trovarel’s own acts or omissions for which Trovarel is legally responsible.


19. Guest Indemnification

To the maximum extent permitted by applicable law, Guests agree to indemnify and hold harmless Trovarel and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, costs, and reasonable legal expenses arising from:

  • the Guest’s unlawful conduct;
  • the Guest’s intentional misconduct;
  • the Guest’s material breach of these Terms;
  • damage caused by the Guest to Host property or third-party property; or
  • the Guest’s violation of another person’s rights.

This section does not limit any legal rights or remedies that cannot lawfully be limited.


20. Assumption of Risk

Some Experiences may involve inherent risks, including physical activity, outdoor environments, transportation, boating, water activities, food, animals, equipment, travel, weather conditions, or interaction with third parties.

Guests acknowledge that they choose to participate in Experiences voluntarily and are responsible for following applicable safety instructions and requirements.

However, nothing in this section excludes or limits liability or consumer rights that cannot legally be excluded or limited.


21. Trovarel Liability

To the maximum extent permitted by applicable law, Trovarel is not responsible for the acts, omissions, negligence, misconduct, representations, qualifications, licenses, permits, insurance, tax compliance, immigration status, employment status, or legal compliance of Hosts or Guests.

Trovarel is not responsible for the actual provision, quality, safety, legality, availability, or suitability of an Experience where responsibility for those matters belongs to the Host.

Trovarel does not guarantee that any Host is appropriately licensed, insured, qualified, authorized to work, tax compliant, or otherwise legally permitted to provide an Experience unless Trovarel expressly states that a particular credential has been independently verified.

Trovarel is not responsible for disputes arising solely between Hosts and Guests, except where Trovarel has a legal responsibility that cannot be excluded.

To the maximum extent permitted by applicable law, Trovarel will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, loss of profits, loss of business, loss of opportunity, or loss of data arising from use of the Services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from Trovarel’s own fraud, intentional misconduct, gross negligence where applicable, or liability for death or personal injury to the extent such exclusion or limitation is prohibited by applicable law.

Where legally permitted, Trovarel’s aggregate liability arising from a user’s use of the Services shall be limited to the amount of platform fees or commissions actually retained by Trovarel in connection with the transaction giving rise to the claim, or, where no specific transaction exists, the amount paid by the user directly to Trovarel during the twelve months preceding the event giving rise to the claim.

Nothing in this section affects mandatory statutory consumer rights.


22. No Insurance Provided by Trovarel

Trovarel does not provide insurance coverage to Hosts or Guests.

Hosts are responsible for determining and obtaining all insurance required by law or appropriate for their activities.

Guests are responsible for determining whether they require personal insurance, travel insurance, medical coverage, activity-specific insurance, or other protection for their participation.

The absence of insurance coverage does not transfer responsibility for obtaining legally required insurance from the Host to Trovarel.


23. Reviews and User Content

Users may submit reviews, photographs, comments, and other content relating to Experiences.

Users must ensure that content they submit is truthful and does not contain unlawful, defamatory, discriminatory, fraudulent, misleading, or infringing material.

Trovarel may remove content that violates these Terms, applicable law, or platform standards.

By submitting content to Trovarel, you grant Trovarel a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and otherwise use that content for operating, promoting, and improving the Services, subject to applicable law and our Privacy Policy.


24. Intellectual Property

The Trovarel name, branding, website, software, design, logos, text, graphics, interfaces, and other platform materials are owned by or licensed to Trovarel and are protected by applicable intellectual property laws.

Users may not copy, reproduce, modify, distribute, sell, reverse engineer, or commercially exploit Trovarel’s intellectual property without prior written permission.

Hosts retain ownership of content they independently create and submit, subject to the license granted to Trovarel under these Terms.

Hosts must have the necessary rights to all photographs, videos, logos, descriptions, and other content uploaded to the platform.


25. Prohibited Conduct

Users may not:

  • use Trovarel for unlawful purposes;
  • provide false or misleading information;
  • impersonate another person;
  • create fraudulent Listings;
  • misrepresent qualifications or licenses;
  • upload deceptive photographs;
  • circumvent Trovarel’s payment system;
  • attempt to avoid Trovarel’s commission;
  • harass, threaten, abuse, or discriminate against another user;
  • engage in fraudulent activity;
  • manipulate reviews;
  • interfere with the operation or security of the Services;
  • collect another user’s personal information without authorization;
  • upload malicious software;
  • infringe intellectual property rights; or
  • otherwise violate these Terms or applicable law.

26. Suspension and Termination

Trovarel may suspend or terminate an account or Listing where reasonably necessary to:

  • enforce these Terms;
  • address safety concerns;
  • address suspected fraud;
  • address suspected unlawful activity;
  • investigate a complaint;
  • comply with legal obligations;
  • protect users or Trovarel;
  • address inaccurate or misleading information; or
  • maintain the integrity of the marketplace.

Where required by applicable law, Trovarel will provide appropriate notice and reasons for certain restrictions or termination decisions.

Users may stop using the Services at any time.

Termination does not eliminate obligations that by their nature should continue after termination, including payment obligations, indemnification obligations, intellectual property provisions, and applicable liability provisions.


27. Third-Party Services

Trovarel may use third-party providers for payment processing, hosting, communications, analytics, identity verification, security, or other platform functionality.

Third-party services may be subject to their own terms and privacy policies.

Trovarel is not responsible for third-party services to the extent that the relevant issue is outside Trovarel’s reasonable control or legal responsibility.


28. Privacy and Personal Information

Trovarel collects and processes personal information in accordance with its Privacy Policy.

Users should review the Privacy Policy before using the Services.

Hosts must not collect, store, or use Guest personal information except as permitted by applicable law and necessary for the provision of an Experience.


29. Marketplace Transparency

Where required by applicable law, Trovarel will provide information identifying whether a Host is acting as a professional trader/business or as a private individual, based on information provided by the Host.

Where required, Trovarel may request information necessary to establish or verify a Host’s identity, business status, contact information, or legal authorization to operate.

Guests should understand that consumer protection rights may differ depending on whether an Experience is provided by a professional trader or a private individual.

Nothing in these Terms alters mandatory consumer rights applicable to a particular transaction.


30. Compliance With Applicable Laws

Hosts and Guests are responsible for complying with the laws applicable to their activities, including the laws of the location where an Experience takes place.

Hosts are specifically responsible for determining the laws and regulations applicable to their Experiences.

This includes, where applicable, laws relating to:

  • business operations;
  • professional licensing;
  • employment;
  • immigration and right to work;
  • taxation;
  • insurance;
  • transportation;
  • maritime activities;
  • health and safety;
  • food and alcohol;
  • environmental protection;
  • consumer protection;
  • accessibility;
  • privacy;
  • intellectual property; and
  • permits and registrations.

Trovarel does not provide legal, tax, immigration, licensing, insurance, or regulatory advice to Hosts or Guests.


31. International Use

Trovarel may be accessible internationally.

The availability of the Services in a particular country or location does not mean that every Experience is lawful or available there.

Hosts are responsible for ensuring that their Experiences comply with the laws of the jurisdiction in which they operate.

Guests are responsible for complying with applicable laws when traveling or participating in Experiences.


32. Consumer Rights

Nothing in these Terms is intended to remove, restrict, or waive any mandatory rights granted to consumers under applicable European Union, European Economic Area, United Kingdom, or national law.

Where applicable law grants a consumer a right to a refund, cancellation, compensation, remedy, or other protection, that right remains unaffected.

If any provision of these Terms conflicts with a mandatory legal requirement, the mandatory legal requirement will prevail and the affected provision will be interpreted or modified only to the extent necessary to comply with the law.


33. Complaints and Disputes

Guests and Hosts are encouraged to first attempt to resolve disputes directly and in good faith.

Trovarel may assist with communications or marketplace-related disputes where appropriate, but Trovarel does not guarantee that it will resolve disputes between Hosts and Guests or accept responsibility for obligations belonging to either party.

Nothing in this section prevents a consumer from exercising any mandatory legal rights or remedies.


34. Governing Law and Jurisdiction

These Terms are governed by the laws applicable to the legal entity operating Trovarel, subject to any mandatory consumer protection laws that apply to a particular user or transaction.

Where a consumer is legally entitled to bring proceedings in their country of residence or another jurisdiction under mandatory law, nothing in these Terms prevents the consumer from exercising that right.

35. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.


36. No Waiver

Trovarel’s failure to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision in the future.


37. Changes to These Terms

Trovarel may update these Terms from time to time to reflect changes to the Services, applicable law, business practices, or platform requirements.

Where required by law, Trovarel will provide notice of material changes.

The updated Terms will be posted on the Trovarel website with an updated effective date.

Where applicable law requires affirmative acceptance of updated terms, continued use of the Services will not substitute for such acceptance.


38. Entire Agreement

These Terms, together with any applicable Trovarel policies referenced within them, constitute the agreement governing your use of the Services, except where additional terms expressly apply to a particular booking, Host arrangement, or service.

By creating an account, listing an Experience, making a booking, or using the Trovarel Services, you acknowledge that you have read and agree to these Terms, subject to all mandatory rights and protections provided by applicable law.

Trovarel helps people discover extraordinary experiences and trusted local services that turn meaningful moments into unforgettable memories.
